CIAA Files Corruption Case Against Tax Officer and CA in NPR 5 Lakh Bribery Scheme
In a significant move against corruption, the Commission for the Investigation of Abuse of Authority (CIAA) has formally filed a corruption case against a tax officer and a chartered accountant (CA) in Kathmandu's Special Court. The charges stem from allegations of soliciting a NPR 500,000 bribe during a tax audit, highlighting persistent challenges in maintaining transparency and integrity within Nepal's revenue administration.
The accused are Yuvraj M. S. Pal, a tax officer at the Inland Revenue Office in Lahan, Siraha, and Ram Rijhan Yadav, a chartered accountant. According to the CIAA's investigation, Tax Officer Pal allegedly harassed a service recipient during the tax audit for the fiscal year 2078/079 (2021/22), claiming that necessary documents were incomplete. This alleged harassment was a precursor to demanding a bribe of NPR 500,000.
The investigation further revealed a concerning modus operandi: Tax Officer Pal reportedly leveraged CA Ram Rijhan Yadav to negotiate and secure bribes from service recipients during the auditing and tax assessment processes for various commercial and industrial firms. The CIAA concluded that Yadav, acting in direct collusion with Pal, accepted the NPR 500,000 bribe from the service recipient and actively facilitated Pal's corrupt activities. The anti-graft body's team from Bardibas successfully apprehended Pal while he was in the act of receiving the illicit payment.
This incident underscores the critical importance of robust oversight and accountability mechanisms within government agencies, particularly those dealing directly with public finances and business compliance. Such acts of corruption not only undermine the rule of law but also severely erode public trust in institutions vital for economic stability and growth. The CIAA has pursued charges against both individuals under the Prevention of Corruption Act, 2059. The commission is seeking imprisonment and a fine equivalent to the alleged bribe amount of NPR 500,000 from both defendants. Furthermore, CA Yadav faces additional scrutiny for allegedly inciting a civil servant to accept a bribe and acting as an accomplice, a serious ethical breach for a professional entrusted with financial integrity. The involvement of a chartered accountant in such a scheme is particularly alarming, as CAs are expected to uphold the highest standards of ethics and professionalism, serving as pillars of financial accountability.
